General conditions of reservation and sale – individual reservations

These conditions of reservation and sale govern the relationship between the hotel restaurant spa VERTE VALLÉE, S.A.S. whose head office is located at 10 rue Alfred Hartmann in Munster, France and its so-called “individual” customers. The reservation of a service offered by the hotel restaurant spa VERTE VALLÉE implies knowledge and acceptance of these general conditions.

Article 1: Conditions of application
These general conditions of reservation and sale (GTC) are accessible at any time on the website of the establishment and apply to the exclusion of all other conditions, and in particular those applicable for other marketing channels of services of the hotel restaurant spa Verte Vallée. Any reservation implies on the part of the Customer full and unreserved acceptance of these conditions, to the exclusion of any other document, prospectus, advertising, etc. In the event of contradiction between the provisions appearing in the quote signed by the Customer and those appearing in these GCS, the provisions of the quote prevail.
Article 2: Conditions for booking rooms and spa treatments
On the establishment's website, the Customer communicates his personal information, selects the services he wishes to book: type of room, price, additional services, and communicates his bank details in order to guarantee his reservation. The Customer acknowledges having read the nature, destination and booking methods of the services offered by the Hotel and having requested and obtained the information necessary to make his reservation in full knowledge of the facts. He is solely responsible for his choice of services and their suitability for his needs, so that the responsibility of the Hotel cannot be sought in this regard. The Customer undertakes to complete the information requested on the reservation request and certifies the veracity and accuracy of the information transmitted. The contractual information is presented in French and is subject to confirmation at the latest when the Customer confirms the reservation. The Customer can modify or cancel his accommodation reservation free of charge up to 48 hours before his arrival. Any treatment or service offered at the establishment's spa, reserved and not canceled at least 24 hours in advance will be invoiced. The reservation made on the hotel's website constitutes the formation of a contract concluded at a distance between the Customer and the establishment.
Article 3: Price guarantee
The reservation is guaranteed at the rates and conditions indicated for the said period, in the event of modification of the dates of stay or according to the number of people occupying the room(s), the rates and conditions are subject to change. In the case of fixed prices, the prices apply globally to the reserved services, these prices cannot be split. The prices and tariffs indicated are in Euros and include all taxes. The rates take into account any reductions that may be granted by the hotel under the conditions specified on the Hotel's website. These prices are firm and non-revisable during their period of validity, as indicated on the Hotel's website, the establishment reserving the right, outside this period of validity, to modify the prices at any time. The rates are indicated before and during the reservation made by the Customer. They are per room for the number of people and the date selected. Rates are confirmed to the Customer. They take into account the VAT at the rate applicable on the day of the reservation; any change in the rate applicable to VAT will be automatically passed on to the prices indicated on the date of invoicing. The same will apply to any modification or introduction of new legal or regulatory taxes imposed by the competent authorities.
Article 4: Deposit
In the event of reservation of accommodation by telephone or by any other means outside the website, a deposit is requested in order to guarantee the reservation and indicated to the Customer during the exchange which precedes the reservation. The non-payment of the deposit at the end of the option date indicated on the contract cancels the reservation. The deposit is non-refundable and will be kept as compensation in the event of a no-show or late cancellation of the reservation.
Article 5: Invoicing and payment
Payment deadline: the amount of the deposit collected is deducted from the final invoice (balance) subject to the application of any cancellation compensation. Unless otherwise provided in the contract, invoices for the balance are payable no later than the day of the Customer's departure. The VERTE VALLÉE hotel restaurant spa does not bear any exchange fees or bank transfer fees. In the event of disagreement on part of the invoice, the Customer undertakes to pay the undisputed part without delay and to inform the hotel restaurant spa VERTE VALLÉE in writing of the reason for the dispute. Amounts paid in advance will not bear interest, similarly, early payment will not benefit from a discount.
Individual payments: the payment of invoices for all services consumed by the Customer will be made at the reception of the hotel restaurant spa VERTE VALLÉE before his departure, in priority on his arrival.
Article 6: Accommodation – allocation of rooms
Accommodation will be provided as a priority at 10 rue Alfred Hartmann in Munster, France (unless special conditions provided for in article 9). The rooms are available from 3:00 p.m. and must be returned by 11:00 a.m. on the day of departure. Failing this, an additional night will be invoiced to the Customer. The VERTE VALLÉE hotel restaurant spa cannot guarantee the grouping of rooms on the same floor for the same group or the allocation of a specific room number.
Article 7: Notes of extras
Any extra bill must be paid before departure and directly at the point of sale of the establishment (restaurant, bar, spa, shop or any other point of sale) at the time of consumption.
Article 8: Data Protection Act - GDPR
In application of the law n° 78-17, known as data processing and freedom, the customers are informed that their order is the subject of a computerized nominative treatment. The policy regarding the protection of the privacy of customers is described in the legal notices accessible on the website of the hotel restaurant spa VERTE VALLÉE www.vertevallee.com/fr/mentions-legales.html
Article 9: Removal
In the event of force majeure or exceptional circumstances, the VERTE VALLÉE spa hotel restaurant reserves the right to have a client accommodated in an accommodation structure offering at least the same services and without price modification.
Section 10: Animals
Small animals are allowed for a daily supplement (according to current rates). The VERTE VALLÉE hotel restaurant spa reserves the right to refuse access to the dining rooms to any animal whose size or behavior could disturb customers.
Article 11: Degradation and deterioration
The VERTE VALLÉE hotel restaurant spa is an entirely non-smoking area. The customer will be held liable for direct and/or indirect, consequential damages resulting from the act of smoking in the Hotel. He will therefore be liable for the full amount of the costs of cleaning and restoring the damaged element or space to its original state. The customer accepts and undertakes to use the room as a good father. Also, any behavior contrary to morality and public order will cause the hotel restaurant spa VERTE VALLÉE to ask the Customer to leave the establishment without any compensation and/or without any refund if payment has already been made. In the event that no payment has yet been made, the customer must pay the price of the nights consumed before leaving the establishment. The Customer will be held liable for all direct and/or indirect, consequential damages of which he is the author, observed in the reserved room or that he may cause within the Hotel. Consequently, it undertakes to compensate the hotel for the amount of said damages, without prejudice to any damages that may be due, procedural costs and legal costs incurred by the hotel.
Article 12: Late arrival – exceeding service hours
In the event of delay or exceeding the agreed times, the customer will bear the full cost of the services reserved by him but not consumed or used because of this delay.
Article 13: Force majeure
In the event of force majeure (fire, water damage, etc.), the VERTE VALLÉE spa hotel restaurant will notify the Customer by registered letter of the cancellation of the stay and will propose a postponement of the deposit paid to a future stay.
Article 14: Complaint – dispute – tourism and travel mediator – competent jurisdiction
Any dispute or complaint can only be taken into account if they are formulated in writing and addressed to the hotel restaurant spa VERTE VALLÉE within a maximum period of 8 days after the end of the event by registered letter with acknowledgment of receipt. After having contacted the litigation department and in the absence of a satisfactory response within one month, the customer may contact the Tourism and Travel Mediator, whose contact details and referral methods are available on his website: www.mtv.travel . The applicable law is French law, all disputes relating to the execution of these clauses of this contract are subject to the jurisdiction of the courts of Colmar.
Article 15: Insurance
The VERTE VALLÉE hotel restaurant spa is insured by GROUPAMA under the reference 10648007E-0003 for a multi-risk contract under the reference 106480070002 for a civil liability contract within the framework of its activities and cannot be held responsible for thefts or damage suffered by baggage and equipment of residents, or damage caused by customers. For a room rental, the private customer can take out additional insurance on his own behalf covering certain specific risks, for professionals and companies, a civil liability certificate and possibly a professional multi-risk insurance certificate - damage to property if the tenant brings back equipment belonging to him.
